DUI/DWI Penalties

If you are suspected of DUI/DWI, you will be asked to submit to a chemical test (see “The Breathalyzer Test” below).

If you agree to the test and have a blood alcohol level of 0.08% or more, your FIRST OFFENSE can result in a 4-month suspension of driving privileges.

If you refuse to submit to or fail to complete a blood alcohol level test, your FIRST OFFENSE can result in a 1-year suspension.

Second DUI/DWI offenses, if you agree to the test, can result in a 1-year suspension. If you refuse to submit to or fail to complete testing, the result from a second offense can be a 2-year revocation. Additional offenses can result in even more-severe penalties.

An Overview of DUI/DWI

The crime of drunk driving is also known as “driving under the influence” or “DUI” and “driving while intoxicated” or “DWI”. A drunk driving conviction can carry serious consequences including jail time, a heavy fine, and temporary suspension or permanent revocation of a driver's license. Other serious consequences can include making it impossible to find or keep a job and care for your family as well as to get auto insurance. This also applies if you are arrested for driving under the influence of drugs.

Parole & Probation

Parole comes after a convicted drunk driver has been imprisoned and released back into society and is subject to supervision for a duration of time set by the court. Probation, however, is the most frequent sentence imposed by the court. It involves releasing the convicted drunk driver without jail time but subject to a list of widely-varying terms and conditions which include a requirement that the guilty party refrain from committing further crimes.

The Prosecutor

A prosecutor is the city, county, or state attorney who presents the case against the alleged drunk driver.

The Breathalyzer Test

The prosecutor must prove that the alleged drunk driver's blood alcohol level at the time of the arrest was at or above legal limits. Scientifically proving excessive blood alcohol level is most often accomplished by the use of a Breathalyzer by law enforcement officials at the scene of the arrest. Blood, hair follicle, or urine testing is sometimes used to also prove excessive blood alcohol level. Vehicle Insurance

After paying a fine, serving a sentence and/or other possible consequences of DUI/DWI, a convicted drunk driver will usually want to reinstate his or her driving privileges and vehicle insurance.
